Weinstein faces up to 18 years in prison for the charges for which he was convicted, but aggravating factors could increase that to 24 years. The lawyers returned to court on Tuesday to present arguments about the aggravating factors.
“While we are relieved that the jury found Weinstein guilty of some counts, we are disappointed that the jury was unable to reach a unanimous verdict on Jane Doe 4,” said Ms. Fegan. .
“She will continue to fight for all women and all survivors of abuse against a system that allows the victim to be shamed and re-traumatized in the name of justice,” she added.
In Los Angeles, Weinstein faced seven counts of rape and sexual assault from four women during confrontations between 2004 and 2013.
A jury acquitted Weinstein of a felony count of sexual battery by restraint involving an alleged attack on a woman, Jane Doe 3, in 2010.
Jurors were unable to reach verdicts on charges of sexual battery by restraint involving an alleged assault in February 2013 against Jane Doe 2 and charges of forced oral sex and forcible rape involving an alleged assault against Siebel Newsom in 2005.
“I am of course disappointed that the jury was divided on some of the counts, but I hope its partial verdicts will bring some degree of justice to the victims,” Los Angeles County District Attorney George Gascon said in a statement.
Within five weeks of testifying in Los Angeles Superior Court, the defendants, including documentary filmmaker Sibel Newsom, said Weinstein lured them into what they thought were business meetings.
The judge declares a mistrial on some counts
Superior Court Judge Lisa Lynch declared a mistrial on counts on which the jury was unable to reach a verdict, including allegations made by Siebel Newsom.
In often filmed testimonies, the women alleged that the producer of Pulp Fiction and Shakespeare in Love masturbated in front of them and groped or raped them.
Sibel Newsom and three other women provided testimony that provided the basis for the two counts of rape and five counts of sexual assault that Weinstein faced.
Four other women have come up with similar stories to support the prosecution’s arguments that Weinstein routinely abused his status as a Hollywood power player to exploit women.
They said he promised to help get an audition or a book deal, then arranged get-togethers where the staff disappeared, leaving them alone with him.
Weinstein said all of his sexual encounters were consensual and he pleaded not guilty.
Defense attorneys argued that the women willingly had sex with Weinstein because they believed it would help them in their careers, part of what they said was the “couch-down” culture pervasive in the film industry. In two cases, they said, the sexual intercourse was fabricated.
They also highlighted that some of the accusers, including Siebel Newsom, had maintained contact with Weinstein, which they said made no sense if he had attacked them.
Siebel Newsom attended the pre-Oscars party Weinstein hosted with her husband, and sent Weinstein dozens of friendly emails over the years.
Weinstein was convicted of sexual misconduct in New York in February 2020. He was extradited from New York to a Los Angeles prison in July 2021.
In New York, Weinstein is appealing his conviction and prison sentence.
